Open Question: If your medical records are personal, how exactly does your employer find out what illness you have?
My childhood friend was diagnosed with HIV two years ago. He paid for his medication with cash because he didn't want his job to find out if he used his insurance policy. Now he has run out of money and has to use insurance to pay for the medication. He's terrified that his job will find out and that they will find a way to get rid of him. Apparently they have done this to other employes who became ill or disabled, but the company covers its tracks well enough to make the dismissals look job related. I can see if the employee makes it known they're sick, but my friend wouldn't do that after paying cash for so long. But isn't medical info confidential? I understand the insurance company would find out, but aren't the legally required to keep mum about it because of HIPPA laws? This has consumed his every thought. He is very difficult to be around now and I am afraid it will have a negative effect on his health. I would like to give him some peace of mind if I can. If I could get an answer from anyone in the field, I would appreciate it.
